2. Victims of domestic violence may seek a protective order to keep the peace
when they've been threatened or abused. However, the procedures available
for obtaining such orders should not be used lightly. The punishment for a parent
placing even a phone call in violation of such an order are severe. A parent can be
ordered to serve four (4) months in jail for violating the terms of a protective
order. Therefore, a victim of domestic violence should consider their need for future
communications with a spouse or parent, employment considerations and child
support needs (an incarcerated parent cannot work to pay child support) before
filing for a protective order.
Forms are available to download from the website or the Administrative Office of Courts for individuals needing the protections of a court order to prevent further abuse or harm. You may find a few of them on the following web page:
You should not attempt to file an action for a Protective Order without consulting an attorney.
